SECEX Ordinance No. 23/2023 was published

On June 16th of this year, SECEX Ordinance No. 23/2023 was published, which initiated the sunset review of the antidumping duty applied to Brazilian imports, originating in India, and classified under subitem 7325.91.00 of the Mercosur Common Nomenclature (“NCM”), of grinding bodies in cast iron and/or chrome alloy steel:

– with a chrome percentage from 17.6 to 22 and a diameter from 57 to 64 mm

– with a chrome percentage from 22 to 28, and a diameter from 11 to 28 mm; and

– with a chrome percentage from 28 to 32, and a diameter from 22 to 35 mm.

The antidumping duty was originally established by CAMEX Resolution No. 39/2018, and was to remain in force until June 19th, 2023. In February, Magotteaux Brasil Ltda. requested the initiation of the sunset review, which was recommended by the Department of Trade Defense (DECOM) due to the existence of sufficient evidence as to the likelihood of resumption of the damage caused by these imports if the antidumping duty were terminated. – Technical characteristics: the product under review is presented in the form of grinding bodies in cast iron and/or chrome alloy steel, with a chrome percentage from 17.6 to 22 and diameter from 57 to 64 mm, a chrome percentage from 22 to 28 and diameter from 11 to 28 mm, and a chrome percentage from 28 to 32 and diameter from 22 to 35 mm.

– Uses and applications: the grinding media reviewed here are used primarily for ore grinding. In addition to grinding various types of ores (iron ore, gold, copper, nickel, phosphate, and bauxite), in certain special cases the product can be used in limestone grinding and in the cement industry.

The participation of interested parties in the process must necessarily occur through interlocking petitions in the Electronic Information System of the Ministry of Development, Industry, Commerce, and Services – SEI/MDIC. Questionnaires will be sent to the identified interested parties, who will have thirty days to return them, as of the date of acknowledgement. Others that consider themselves as interested parties and have not been identified as such may request their qualification until July 6th.

Article 6 of SECEX Ordinance No. 13/2020 states that a public interest assessment will be optional, initiated upon request submitted based on a duly completed Questionnaire of Public Interest or ex officio at the discretion of DECOM.”
